ARTICLE 2 - PURPOSE
These General Terms and Conditions of Sale (GTCS) govern the contractual relations between Clickzou, publisher of the Plyz application, and any user wishing to purchase paid services through the application.
Plyz is a platform that allows:
- Fans to obtain personalized signatures from celebrities during live sessions
- Celebrities to monetize their interactions with fans
ARTICLE 3 - SERVICES OFFERED
3.1 Live Sessions
Celebrities can organize live signing sessions. Fans can join these sessions for the price set by the celebrity.
3.2 Pricing
The price of each session is freely set by the celebrity. The minimum price is €2 per session.
ARTICLE 4 - COMMISSION AND FEES
4.1 Operating Fees
Fees are applied to each transaction, distributed as follows:
- Plyz commission: 15% of the transaction amount
- Stripe processing fees: 2.9% + €0.30 per transaction
The revenue amount displayed in the application is an approximate estimate. The exact amount may vary slightly due to bank processing fees (Stripe fees), rounding calculations, and possible exchange rate variations.
4.2 Celebrity Revenue
Celebrities receive 85% of the amount paid by fans, minus Stripe processing fees (2.9% + €0.30 per transaction).
ARTICLE 5 - PAYMENT
5.1 Payment Methods
Payments are made by credit card via Stripe Checkout, a secure payment system.
5.2 Pre-authorization and Payment Capture
When booking a live session, the amount is pre-authorized (reserved) on the fan's credit card without being charged immediately. The actual charge (capture) only occurs at the end of the video call, according to the following conditions:
a) The video call ends normally (the timer reaches zero): the fan is charged the full amount.
b) The fan ends the call before the timer runs out: the fan is charged the full amount. Voluntary termination of the call by the fan does not entitle any refund.
c) The celebrity ends the call before the timer runs out: the fan is NOT charged. The pre-authorization is cancelled and the reserved amount is released on the fan's card.
d) The fan was never called (queue not reached or session ended): the fan is NOT charged. The pre-authorization expires automatically.
e) For live signing (dedication) events, the same pre-authorization principle applies: the fan is charged as soon as the celebrity publishes at least one signed photo in the event (the gallery being shared among all participating fans). If the celebrity publishes no signed photo, in particular if the event is cancelled, the fan is NOT charged and the pre-authorization is released.
5.3 Payment to Celebrities
Celebrity earnings are paid within 30 days via Stripe Connect. The celebrity must have a verified Stripe Connect account to receive payments. Only sessions that are effectively completed (timer reached zero or fan voluntarily left) generate revenue for the celebrity.
5.4 Transaction Security
All transactions are secured by the Stripe payment system.
ARTICLE 6 - RIGHT OF WITHDRAWAL AND REFUND
6.1 Waiver of Right of Withdrawal
In accordance with Article L221-28 of the Consumer Code, the user acknowledges and accepts that the service offered by Plyz constitutes digital content provided on an intangible medium whose execution begins immediately after order validation.
By validating their reservation for a live session, the user expressly waives their 14-day right of withdrawal provided by the Consumer Code.
6.2 Billing and Non-billing Conditions
The fan is billed only in cases where the video call has actually taken place and ended either by the natural expiration of the timer or by voluntary interruption by the fan.
The fan is not billed when the celebrity ends the call before the timer expires, or when the fan was not called during the session.
In case of technical interruption (connection problems, platform malfunction), if the disconnection is detected as originating from the celebrity's side, the fan is not billed. If the disconnection originates from the fan's side, the payment is maintained.
6.3 Acceptance of Conditions
Before any paid reservation, the user must check a box confirming that they have read and accepted these conditions, including the billing conditions.
ARTICLE 7 - OBLIGATIONS OF THE PARTIES
7.1 Plyz Obligations
- Ensure proper technical operation of the platform
- Guarantee transaction security
- Pay celebrity earnings within agreed deadlines
7.2 Celebrity Obligations
- Honor scheduled sessions
- Comply with rules of conduct
- Have a verified Stripe Connect account
7.3 Fan Obligations
- Make payment before the session
- Comply with rules of conduct
- Be of legal age (minimum 18 years)
ARTICLE 8 - LIABILITY
8.1 Limitation of Liability
Plyz cannot be held liable for:
- The content of exchanges between celebrities and fans
- Cancellation of a session by a celebrity
- Technical problems related to user equipment
8.2 Force Majeure
Plyz cannot be held liable in case of force majeure (generalized server failure, natural disaster, etc.).
8.3 Stripe Geographic Restrictions
Payments to celebrities are made via Stripe Connect. Stripe is not available in all countries. It is the celebrity's responsibility to verify that Stripe is available in their country of residence before creating a paid live session. The list of countries supported by Stripe is available on the official Stripe website (https://stripe.com/global).
If a celebrity is located in a country where Stripe is not available or not authorized, Plyz cannot under any circumstances be held responsible for the inability to receive payments. No refund will be granted to fans who participated in a session of a celebrity whose Stripe account cannot be activated or verified due to geographic restrictions.
The celebrity assumes full responsibility for verifying the eligibility of their country with Stripe and releases Plyz from any liability in case of payment impossibility related to these restrictions.
ARTICLE 9 - LIMITATION OF TECHNICAL LIABILITY
Plyz provides a platform for connection and broadcasting. Plyz cannot be held liable for technical failures attributable to the user or their environment, in particular: discharged battery, loss or weakness of the internet connection or mobile network, defective equipment, closure of the application, or any other incident beyond Plyz's control. When the service has actually been rendered or started (the video call took place, or at least one signed photo has been published) and an interruption occurs for a cause attributable to the user or their equipment, the service is deemed provided and the amount remains due.
ARTICLE 10 - INTELLECTUAL PROPERTY
Digital signatures created via Plyz remain the intellectual property of their author (the celebrity). The fan obtains a personal and non-commercial right to use the received signature.
ARTICLE 11 - PERSONAL DATA
The processing of personal data is detailed in our Privacy Policy, accessible in the application.
ARTICLE 12 - LIVE VIDEO SESSIONS, PRICING AND INTERNAL PROMOTIONAL CODES
11.1 Pricing of Live Video Sessions
The live video sessions offered through the Plyz application are exclusively paid services, accessible to users at the rates set by each creator (hereinafter "the celebrity"). No session may be conducted free of charge, except within the strict and limited framework provided below.
11.2 Internal Promotional Codes
Plyz reserves the right to generate and use specific promotional codes, allowing free or reduced-rate access to certain live video sessions. These promotional codes are strictly reserved for internal use by Plyz teams or by any person authorized by the platform.
11.3 Purpose of Promotional Codes
The use of these codes is exclusively intended to:
- Verify the identity and authenticity of the celebrity offering the session
- Monitor the compliance of the services offered with the platform's terms of use
- Conduct moderation or quality control operations
- Process any reports made by users
- Prevent fraud, identity theft or inappropriate behavior
11.4 Impact on Estimated Celebrity Revenue
Connections made by Plyz teams via internal promotional codes may result in a discrepancy between the estimated revenue amount displayed in the application and the amount actually received by the celebrity. Indeed, sessions conducted as part of internal controls do not generate revenue for the celebrity. The celebrity acknowledges and accepts that the estimated amount displayed is indicative and may not correspond exactly to the final amount paid.
11.5 Restrictions and Prohibitions
Internal promotional codes:
- May under no circumstances be used for commercial or promotional purposes by users or celebrities
- Must not be distributed, shared or made public
- May be deactivated at any time without prior notice by Plyz
Any abusive, fraudulent or unauthorized use may result in:
- Suspension or deletion of the account concerned
- Cancellation of the sessions concerned
- Legal proceedings in accordance with applicable regulations
11.6 Platform's Right of Control
By accepting these conditions, users and celebrities acknowledge that Plyz reserves the right to carry out periodic and random checks, in particular via these promotional codes, in order to guarantee the quality of the service, the safety of users and the integrity of the platform.
ARTICLE 13 - MODIFICATION OF GTCS
Plyz reserves the right to modify these GTCS at any time. Users will be informed of any modification by notification in the application.
ARTICLE 14 - APPLICABLE LAW AND DISPUTES
These GTCS are subject to French law. In case of dispute, an amicable solution will be sought before any legal action. Failing that, the courts of Toulouse will have jurisdiction.
